Retail Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the online retail store operated by Depot Arts and Music Space Trust (“we”, “us”, “our”) based in Auckland, New Zealand. By accessing or purchasing from our online store, you agree to be bound by these Terms.
1. General
1.1 These Terms apply to all purchases made via our website www.depot.org.nz.
1.2 We reserve the right to update or change these Terms at any time. Continued use of the site following changes constitutes acceptance of the new Terms.
2. Products and Pricing
2.1 All artworks, prints, merchandise, and other items displayed on our website are subject to availability.
2.2 Prices are listed in New Zealand Dollars (NZD) and include GST (Goods and Services Tax), unless otherwise stated.
2.3 We reserve the right to change product prices at any time without notice. Prices at the time of purchase are final.
2.4 All descriptions and specifications are correct at the time of publication and have been written to the best of our ability. However, we cannot guarantee that all descriptions, specifications and content are entirely accurate or error-free.
2.5 Photographic representations of products on our website do provide a close representation of the products in real life, however, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by the customer.
2.6 Measurements of products’ physical dimensions may be an approximation and are intended as a guide.
3. Orders
3.1 By placing an order, you confirm that all details provided are accurate and that you have the legal capacity to enter into a contract.
3.2 Once you submit an order, you will receive an order confirmation email. This does not constitute acceptance of your order, only acknowledgment of receipt.
3.3 We reserve the right to refuse or cancel any order at our discretion, including but not limited to issues of stock availability, payment issues, or suspected fraud.
4. Payment
4.1 We accept payment through major credit cards, debit cards, and other secure online payment methods listed at checkout.
4.2 All payments must be made in full before dispatch.
5. Shipping and Delivery
5.1 We deliver throughout New Zealand and to select international destinations. Delivery times and fees will vary based on your location and shipping method chosen.
5.2 We aim to dispatch items within [e.g., 3–5 business days] of payment confirmation. Delivery timeframes are estimates only and we are not liable for delays caused by shipping providers.
5.3 Risk in the products passes to you upon delivery.
5.4 If store pick up is requested, we will store all artworks, prints, merchandise, and other items for a maximum period of 12 weeks after the date of purchase, after which time ownership of the work is transferred to Depot Arts and Music Space Trust.
6. Returns and Refunds
6.1 Under the Consumer Guarantees Act 1993 (NZ), you are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage.
6.2 If the product you receive is damaged, faulty, or incorrect, please contact us at toitoa@depot.org.nz within 7 days of delivery with supporting photographs.
6.3 We do not offer refunds for change of mind, but may offer a store credit or exchange at our discretion (excluding original shipping costs).
6.4 Custom-made, commissioned, or limited-edition items may not be eligible for return unless faulty.
7. Intellectual Property
7.1 All artworks, images, designs, and content on our website are the property of Depot Arts and Music Space Trust or the respective artists and are protected by copyright laws.
7.2 You may not reproduce, distribute, or use any content, artworks, images or designs for commercial purposes without written permission.
8. Privacy and Security
8.1 We are committed to protecting your privacy in accordance with the New Zealand Privacy Act 2020.
8.2 Personal information collected during the ordering process is used solely to process and deliver your order and will not be shared with third parties, except as required for fulfilment.
8.3 Our website uses secure encryption to protect your payment and personal data.
9. Liability
9.1 We shall not be liable for any indirect or consequential loss or damage arising out of your use or inability to use our website or products.
9.2 Our liability is limited to the purchase price of the product.
10. Governing Law
10.1 These Terms are governed by the laws of New Zealand.
10.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
